Minutes of the June 23, 2008 Regular Meeting were read and accepted.
Motion by Miller to pass at its third reading, ORDINANCE 2008-9; AN ORDINANCE ACCEPTING THE RECOMMENDATION OF THE PLANNING COMMISSION AS TO THE ZONING OF NEWLY ANNEXED TERRITORY TO THE VILLAGE OF PAYNE, PAULDING COUNTY, OHIO. Seconded by Feasby, Motion Carried.
Motion by Speice to amend RESOLUTION 2008-J,to change the 7th paragraph phrase "FOR COLLECTION COMMENCING IN YEAR 2009, IF 51% OF THE ELECTORS VOTING THEREON VOTE IN FAVOR THEREOF, AND" to "FOR COLLECTION COMMENCING IN YEAR 2008, IF THE MAJORITY OF THE ELECTORS VOTING THEREON VOTE IN FAVOR THEREOF; AND". Seconded by Childs, Motion carried.

Motion by Miller to adopt RESOLUTION 2008-K; OHIO DEPARTMENT OF TRANSPORTATION'S REHABILITATION OF TWO-LANE ROADWAY BY PLANNING AND RESURFACING, PLACING CURB RAMPS, RPM's AND PAVEMENT MARKINGS, LYING WITHIN THE VILLAGE OF PAYNE. Seconded by Childs. Motion carried.
Mayor Speice reported the State of Ohio has accepted the Village's Grant application for a new fire siren for the west side of the Village. The Grant application must also be approved by the Federal government.
Speice stated 5 benches have been purchased for the village at a cost of $2,315.75 which were mostly funded by donations. Donation recognition plaques will be ordered from Fessels Jewelry.

Motion by Speice to adopt RESOLUTION 2008-L; A RESOLUTION REQUESTING THE COUNTY AUDITOR TO CERTIFY TO THE VILLAGE OF PAYNE THE TOTAL CURRENT TAX VALUATION OF SAID VILLAGE AND THE DOLLAR AMOUNT OF REVENUE THAT WOULD BE GENERATED BY 1.7 MILL FOR A REPLACEMENT LEVY FOR THE OPERATION OF THE VILLAGE'S FIRE DEPARTMENT IN ACCORDANCE TO OHIO REVISED CODE SEC. 5705.19(I) AND 5705.191, AND DECLARING AN EMERGENCY. Seconded by Childs. Motion carried.

Motion by Miller to adopt RESOLUTION 2008-M; A RESOLUTION AUTHORIZING THE MAYOR OF THE VILLAGE OF PAYNE, OHIO, TO ENTER INTO ANY AND ALL NECESSARY AGREEMENTS RELATED TO THE COMMUNITY REINVESTMENT AREA PROGRAM APPLICATION OF FOXBURY APARTMENTS, AND DECLARING THE SAME AN EMERGENCY. Seconded by Childs. Motion carried.
Mayor Speice reported Tri County Roofing repaired flashing from the Mayor's office to the Police Department due to new water leaks through the ceiling tile.
Mayor Speice reported Solicitor Sponseller advises the Village to use the Ohio Revised Code 112 rather than the Green River Ordinance in dealing with peddlers and door to door salesman. Motion by Miller to assess a $25 per salesman application fee for peddlers and door to door salesman wanting to sell products in the Village. Seconded by Feasby. Motion carried.
Motion by Miller to accept the Zoning Board's recommendation to zone the 17.395 acres purchases by the Village on SR 500 as A-1 Agricultural District. Seconded by Childs. Motion carried.
Mayor Speice reported the Village website is in operation.
Motion by Speice to transfer $10,000 from the General Fund to the Police Fund. Seconded by Childs. Motion carried.
Motion by Miller to transfer $10,000 in appropriations from the Permissive Auto fund to the State Highway Fund. Seconded by Childs. Motion carried.
Mayor Speice reported Poggemeyer Design Group has solicited bids from three companies to do soil borings at the sewage retention pond site.
